The Unitary Patent and the Unified Patent Court (UPC) will come into effect on June 1, 2023. Since March 1, 2023, the “Sunrise Period” already allows to act on European patents and European patent applications, especially to derogate from the exclusive competence of the UPC by filing an “opt-out”.
