The SAIL Foundation: a strong message regarding the structuring of IP in artificial intelligence

In early April, major players in the AI sector launched the SAIL Foundation, a patent pool focused on AI models. Founding members include Anthropic, IBM, Meta and Microsoft.

As AI models are developed and deployed by various players, the intellectual property landscape in AI is beginning to become as complex as that of the telecoms sector, with its well-known standard-essential patents.

In this context, SAIL is likely to provide a solution to the difficulty of accessing patented AI technologies (cross-licensing, FRAND-type obligations).

The scale of the IP involved (over 33,000 patent families filed since 2019 by SAIL members) and the influence of its members make this initiative a key focus for any AI IP strategy.

For both innovative companies and established players, navigating this changing landscape requires a detailed assessment of the risks and opportunities relating to patents and licences. Strategic support at an early stage is more crucial than ever.
