Official tax increases in Canada: steps you can take to reduce the impact on your budget

The Canadian Intellectual Property Office (CIPO) recently announced a substantial increase in its official taxes. This increase will take effect on January 1, 2024.

The increase is particularly significant for trademarks: nearly 35% for filing fees and nearly 30% for renewal fees. 

It is also significant for patents: more than 30% for filing fees, examination fees and most annuities; more than 30% for national fees to be paid upon entry into phase in Canada. 

Registrations are also affected: more 25% starting next year.

Regimbeau recommends that its clients anticipate this increase, and carry out before January 1, 2024, the operations already identified as being due for next year or the following years:

–  Trademarks:  

  • Anticipation of registrations and renewals;

– Patents:  

  • Anticipation of direct filings in Canada under priority ;
  • Anticipation of phase entries in 2023 for PCT applications in progress; 
  • Anticipation of examination requests; 
  • Anticipation of annuity payments, even over several years, as the Canadian system allows. 

– Registrations

  • Registrations for transfers and licenses starting this year.
