Paris, 23 July 2020 – Neither Brexit nor Covid-19 seems to have hindered the motivation of the European Commission (EC) to see the project of the Unified Patent Court (UPC) and the Unitary Patent realized.

On July 15, Thierry Breton, speaking on behalf of the EC, even seems to have sent a real message to Germany, that of not the ratification of the UPC Agreement because of the Covid-19 but, on the contrary, to finally give life to it despite this exceptional economic context and to support European companies.

Indeed, the EC is of the view that the withdrawal of the United Kingdom from the European Union (EU) does not affect the ratification process of the Agreement. According to the EC, although the UK will not participate in this system reserved for EU member countries, it was still a member when it ratified the Agreement.

As in response to the EC, the UK on July 20 indicated its withdrawal from ratification of the Agreement. https://www.unified-patent-court.org/news/uk-withdrawal-upca
