Copyright holders can therefore use this tool to monitor their creations.
When COPYTRACK identifies a reproduction on an Internet site, it will contact its publisher and ask the latter to :
- justify its right to reproduce the identified photo (by sending a signed licence, for example); or
- withdraw the photo and pay compensation (assessed by COPYTRACK); or
- pay the costs relating to a licence agreement for a specified period.
However, although this is a powerful tool, it cannot yet assess either the level of originality of the photograph in question or the intensity of its use.
As a result, COPYTRACK claims can sometimes be contested/contestable, or even unfounded.
Therefore, do not hesitate to contact us if you receive a letter from COPYTRACK so that we can help you assess the relevance of its requests.
